Transfer Civil Miscellaneous Petition filed under Section 24 of C.P.C., to transfer A.S. No.289/2016 pending on the file of XVI Additional City Civil Court, Chennai to XV Additional City Civil Court, Chennai where A.S. No.60/2016 and A.S. No.249/2016 is pending for joint disposal.

Aggrieved parties preferred appeals in A.S. Nos.60/2016, 249/2016 and 289/2016 against the common judgment and decree in https://hcservices.ecourts.gov.in/hcservices/

O.S. No.8867/2006 batch. A.S. Nos.60/2016 and 249/2016 are pending before XV Additional City Civil Court, Chennai and A.S. No.289/2016 is pending before XVI Additional City Civil Court, Chennai and it is necessary that all the appeals have got to be heard together.

2. Both parties have no objection for the appeals being transferred and heard together by one court. Taking note of the fact that two appeals are pending on the file of XV Additional City Civil Court, Chennai, A.S. No.289/2016 pending on the file of XVI Additional City Civil Court, shall be withdrawn and transferred to XV Additional City Civil Court, Chennai, so that a composite decision can be taken by the lower appellate court.

3. In view of the same, A.S. No.289 of 2016 pending on the file of XVI Additional City Civil Court, Chennai, is withdrawn from the said court and transferred to the file of XV Additional City Civil Court, Chennai for being tried along with A.S. No.60/2016 and 240/2016, which are already pending in the said court.

4. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
