2.The learned counsel appearing for the other side has not raised any objection.

3.Since the third defendant has filed the written statement in time and having regard to the averments made in the affidavit filed along with the application, in order to give fair opportunity to the third defendant the delay is condoned. Accordingly, the application is ordered.
