This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 29.09.2024, seeking bail in Crime No.748 of 2024 for the alleged offences punishable under Section 332(b), 296(b), 118(1), 109, 351(3), 303(2) of BNS. 2.The case of the prosecution as per the Defacto Complainant is that he was the Advocate for the Accused and due to some misunderstanding between them, the Accused had trespassed into the house of the Defacto Complainant and abused and assaulted him and his wife with a knife, resulting in injuries to both of them. Hence the case. 3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in custody from 29.09.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 1/3

4.Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner/accused was remanded to custody on 02.10.2024. He further submitted that in the above said incident the Defacto Complainant and his wife sustained grievous injuries, hence, he opposed for granting bail to the petitioner.

5.Heard both sides and perused the materials available on record. 6.Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and considering the nature of injuries sustained by the Defacto Complainant and his wife, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, the Criminal Original Petition stands dismissed for the present.
