Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the 1st respondent to transfer the investigation in crime No.91 of 2023 dated 17.04.2023 pending on the file of the 3rd respondent to the 4th respondent in accordance with law within the time stipulated by this Hon'ble Court.

The grievance of the petitioner is that the complaint registered in Crime No. 91 of 2023, dated 17.04.2023 is not shown any headway in the investigation by the 3rd respondent and therefore, the matter has been transferred to the Specialised Investigation Agency dealing with Cyber Crime.

2. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that on-line fraud to the tune of Rs.2.35 crores, wherein, 10 persons were suspected as accused and three of them were arrested and released on bail under Section 167(2) of Cr.P.C and the rest of 2/5

the accused are attending enquiry and investigation is in progress. The learned Government undertakes that the investigation will be completed by the period of three months.

3. Recording the same, the Writ Petition is disposed of holding that the third respondent being the competent to investigate the case, there is no necessity for the present to transfer the case to the Cyber Crime Branch. However, the third respondent shall stick on the time schedule and complete the investigation, within the period of three months, as stated above. No costs.
