Heard Mr.V.Raghavachari, learned advocate for the petitioner and Ms.Susanna Prabhu, learned advocate for the appellant.

Having heard learned advocate for the respective parties, we find that, the petitioner can not be termed to be a necessary party, however, he may be a proper party, to the limited extent of the benefit which he may get in the event the order impugned in the appeal is not interfered with. For that limited purpose, let him be joined as party respondent. Ordered accordingly.

We make it clear that the present petitioner may not be permitted to address the Court why the disqualification of the present appellant was just and proper.
