Praveen Kumar .. Respondent in both Tr.CMPs PRAYER: These Transfer Petitions filed under Section 24 of CPC to withdraw F.C.O.P.Nos.1486 of 2014 and 3921 of 2014 on the file of III Additional Family Court, Chennai and transfer the same to any other competent Court at Chennai.

For Petitioner : Mr.P.B.Ramanujam For Respondent : Mr.T.Venkatesh Kumar COMMON ORDER The petitioner has filed F.C.O.P.No.1486 of 2014 before the III Additional Family Court, Chennai for restitution of conjugal rights and respondent filed a petition for divorce before the Sub Court,

Poonamallee and the same was transferred of the III Additional Family Court, Chennai and re-numbered as F.C.O.P.No.3921 of 2014.

2. The present petitions for transfer had been filed by the wife on certain issues. When the matter is taken up today, after advancing argument for some time, the counsel for both sides arrived at a consensus.

3. By consent, both the parties agreed for transfer of the above said petitions to the file of Principal Family Court, Chennai. Learned counsel for the parties have further consented that the evidence of the parties will be completed, as expeditiously as possible.

4. Considering the facts and circumstances of the case, F.C.O.P.Nos.1486 of 2014 and F.C.O.P.No.3921 of 2014 are transferred from the file of III Additional Family Court, Chennai to the Principal Family Court, Chennai. There shall be a direction to both the parties to co-operate in completing the evidence in order to conclude the trial, on day to day basis.

5. Based on the affirmation given before this court by both sides, a direction is given to post the matters on 24.07.2017 for hearing before the Principal Family Court, Chennai, and a further direction is issued to the learned Principal Judge, Family Court, Chennai, to complete the proceedings, within a period of one month from today.

6. These petitions are ordered accordingly. No costs. Consequently connected Civil Miscellaneous Petitions are closed. 11.07.2017 Speaking Order/Non-speaking Order Index :Yes/No Note: Registry is directed to issue order copy on 12.07.2017.
