This Petition has been filed to condone the delay of 170 days in preferring the above appeal.

2.As regards R1 is concerned, the learned counsel for the petitioner submits that notice may be dispensed with.

3. Considering the submissions made by the learned counsel for the petitioner, notice in respect of R1 is dispensed with.

4.Having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 170 days is condoned subject to the condition that the claimants/petitioners will not be entitled to any interest for the delay period i.e., for 170 days, in the appeal.

5.Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission.

6. Registry is further directed to print the name of the respondents in the cause list, at the time of admission.
