Crl.M.P.No.18863 of 2023 in Crl.A.No.2 of 2020 A.D.JAGADISH CHANDIRA, J.

This petition has been filed seeking to relax the condition imposed by this Court upon the petitioner/appellant in Crl.M.P.No.1810 of 2021 in Crl.A.No.2 of 2020 vide order dated 25.02.2021, to appear before the trial Court once in every three months on the first working day of the particular month at 10.30 a.m., starting from April 2021, until further orders.

2. Learned counsel for the petitioner/appellant submitted that the petitioner, due to his old age ailments, finds it difficult to travel all the way from Bangalore to Chennai to appear before the trial Court. He further submitted that the condition in respect of the co-accused in this case has also been relaxed by this Court vide order dated 03.12.2021 in Crl.M.P.No.12835 of 2021. He also submitted that the petitioner's wife is physically and mentally sick and there is no one to take care of her health, therefore, he prayed to relax the condition.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this criminal miscellaneous petition stands ordered and the condition by this Court in Crl.M.P.No.1810 of 2021 in Crl.A.No.2 of 2020 vide order dated 25.02.2021, is modified to the effect that "the petitioner shall appear before the trial Court once in six months on the first working day of the particular month at 10.30a.m., starting from the 1st working day of January 2024, until further orders."
