PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the 1st respondent to transfer the investigation in Crime No.455 of 2018 from the file of the 2nd respondent to any officer not below the rank of Deputy Superintendent of Police.

O R D E R

The ground on which the petitioner seeks to transfer the investigation in Crime No.455 of 2018 is that, though the FIR was registered on 22.08.2019 and this Court, by an order dated 23.01.2019 passed in Crl.O.P.No.1639 of 2019 had directed the respondent police to complete the investigation and file a final report within a period of three months, the said order has not been complied till date.

2.The learned Additional Public Prosecutor would submit that the investigation is in progress and that they would endevour to complete the investigation as expeditiously.

3.This Court is of the view that one final opportunity could be extended to the respondent herein and since only ground on which the petitioner seeks for transfer of investigation is for non-compliance of the earlier order of this Court, it would be appropriate to extend the time for completing the investigation. 4.In the light of the above observations, there shall be a direction to the 2nd respondent herein to complete the investigation in Crime No.455 of 2018 as expeditiously as possible, in any event, within a period of three weeks from the date of receipt of a copy of this order. Such an investigation shall be monitored by the Superintendent of Police, Cuddalore District, who is the 1st respondent herein, on a day-to-day basis.

5.Accordingly, this criminal original petition is disposed of.
