The petitioner, who apprehends arrest at the hands of the respondent Police for the offence under Sections 3(2)(a), 4(2)(c) and 5(1)(d) of Immoral Traffic (Prevention) Act, in Crime No.142 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. When the matter is taken up for hearing, there is no representation for the petitioner.

3. The case of the prosecution is that the accused was running a brothel house by engaging three victims. The respondent Police had secured three victims and registered the case against the accused. Hence the case.

4. It is seen from the records that this is the third application for anticipatory bail filed by the petitioner before this Court and this Court had dismissed the earlier bail applications filed by the petitioner in Crl.O.P.Nos.7800 & 10222 of 2023 vide orders dated 13.04.2023 and 24.07.2023 respectively. Further,

despite the dismissal of the earlier bail applications, the petitioner has not been secured. Thereby, the present petition has been filed.

5. Learned Government Advocate (Crl.Side) submitted that the petitioner is a habitual offender, against whom, 6 previous cases of similar nature are pending, and also earlier detained under Act 14. He further submitted that the petitioner is a resident of Maharashtra who is habitually engaged in the business of running brothel house by engaging victims from Maharashtra and also from various other states. He also submitted that this Court, taking into consideration the previous antecedents of the petitioner, had dismissed the earlier anticipatory bail applications filed by the petitioner. He further submitted that there is no change of circumstances. Hence, he prayed for dismissal of the petition.

Taking into consideration the above facts and circumstances and the submissions made by the learned Government Advocate (Crl.Side) that six previous cases of similar nature are pending against the petitioner and there is no change of circumstances and also considering the conduct of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 22.11.2023 ham
