ORDER
The present writ petition has been filed with a prayer to quash the impugned order in Che.Mu.Aa.No.9106462/CPanir1/2025 dated 14.08.2025 issued by the 1st respondent.
2. The learned counsel for the petitioner submits that the petitioner is presently serving in the Government Middle School for Hearing Impaired, Tambaram Sanitorium. However, by the impugned order dated 14.08.2025, she has been directed to join as a Secondary Grade Teacher in Government Deaf-dumb Higher Secondary School in Thanjavur. It is the specific contention of the petitioner that she is a widow, aged 55 years.. Apart from that, her mother who is aged 75 years suffering from Arthrities and other age related ailments and she is completely bedridden. The petitioner is also having a son. In view of these circumstances, learned counsel further submits that the transfer to Thanjavur at this stage would severely impact her family situation. It is also submitted that if she continues her service in Chennai, she would be able to get assistance/support from her relatives/extended family. Hence, the learned counsel prays to interfere with the impugned order of transfer.
3. The said contention was strongly opposed by the learned
Additional Government Pleader appearing on behalf of the respondents and submitted that the order is dated 14.08.2025 and there is no instructions as to whether the petitioner has been relieved and taken on charge in Kancheepuram or not. He further submitted that the transfer has been effected purely on administrative grounds.
4. I have given my anxious consideration to either side submissions and also perused the materials available on record.
5. As rightly contended by the learned Additional Government Pleader, the transfer has been effected on account of administrative exigencies. Therefore, this Court finds no valid ground to interfere with the said order. However, considering the petitioner's personal and family circumstances, this Court deems it appropriate to permit the petitioner to submit a representation to the first respondent on 11.09.2025 along with the copy of this order. Upon receipt of such representation, the first respondent is directed to consider and dispose of the same on its own merits and in accordance with law, within a period of one week from the date of receipt of the said representation. Till such time, there shall be an order of status quo as on today. However, it is made clear that the
petitioner shall abide by the final decision to be taken by the first respondent on such representation.
