The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294 (b), 341, 323, 406, 420, 506 (ii) IPC, in Crime No.479 of 2023, on the file of the respondent police seek anticipatory bail.

2.The learned counsel for the petitioners states that the petitioners are innocent persons and they have been falsely implicated in this case. Thus, he prays for grant of anticipatory bail for the petitioners. 3.The second accused is the husband of the first petitioner and the third accused is the father of the second accused. It is stated that the second accused had been taken into custody and subsequently granted bail. 4.The case of the prosecution is that the defacto complainant owned a plot of 4.5cents, out of which, there is a building of 1.5 cents. The petitioners also owned a plot of land. It is stated that there was an oral agreement for exchange of plots. The defacto complainant executed a sale deed for their plot, 1/3

but the petitioners had not executed the sale deed for their plots. 5.This issue will have to be examined only during the trial. As all the facts require further investigation, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed. sli 17.11.2023 2/3
