C.M.P. Nos.27208, 27210 and 27211 of 2023 in S.A. No.759 of 2021 ABDUL QUDDHOSE, J.

C.M.P. Nos.27208, 27210 and 27211 of 2023 have been filed by the petitioners i) to condone the delay of 468 days in filing the petition to set aside the abatement caused due to the death of the sole appellant; ii) to set aside the abatement caused due to the death of the sole appellant and iii) to bring on record the legal representatives of the deceased sole appellant as appellants 2 to 4 in the above main appeal.

2. Heard Mr.G. Anabayachozhan, learned counsel for the petitioners.

3. The learned counsel for the respondents 5 to 7 has stated no objection for allowing these applications.

4.This Court is satisfied with the reasons contained in the affidavit filed in support of these petitions as sufficient cause has been shown. Accordingly, these petitions are allowed. 1/3

5. Registry is directed to carry out necessary amendments and post the Second Appeal on 28.06.2024.
