ORDER

This petition has been filed challenging the order G.O. (Ms) No. 193 Tourism, Culture and Religious Endowments (RE3.1) department dated 4.08.2022 issued by 1st respondent in R.P. No. 2 of 2020 and quash the same and direct the 1st respondent to implement the order of the 3rd respondent dated 10.08.2016 in MP No. 7756 of 2012.

2. It is the case of the writ petitioner that there was serious dispute in between the petitioner and the private respondents for appointment of hereditary trustee in Arulmigu Apparsamy Temple situated at Mylapore, Chennai. Now, the petitioner's father has made an application under Section 54(1) of TN HR & CE Act seeking to record him as one of the hereditary trustee/next line of succession, however, the same was rejected vide the impugned order. Challenging the same, the present writ petition.

After raising various grounds, the learned counsel for the petitioner seeks liberty of this Court to file appropriate civil suit and also seeks for an order of this Court that the period of limitation may be excluded for filing civil suit from the date of application pending before the authorities.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader (HR&CE) and the learned counsel for the respondents 5

and 7 and perused the materials placed on record.

5. Considering the facts and circumstances of the case and the petitioner seeks liberty to file a civil suit before the appropriate civil forum, liberty is granted to the petitioner to file a civil suit before the appropriate civil forum and further, the period of application pending before the authorities and in prosecuting this writ petition before this Court is excluded for the purpose of limitation enabling the petitioner to file a civil suit.
