A.No.8948 of 2019 in C.S.No.497 of 2019 N.SATHISH KUMAR.J., This application is filed by the applicant/second defendant to set aside the order of this Court dated 04.10.2019, setting the second defendant ex-parte and allow the second defendant to contest the suit in C.S.No.497 of 2019.

2.The learned counsel appearing for applicant submitted that though the applicant was not aware of the instant suit, since she was yet to receive the summons and copy of the plaint she could not enter appearance and prayed to set aside the ex-parte order.

3.This Court is of the view that in order to give fair opportunity to the second defendant the ex-parte order dated 04.10.2019 is set aside.

Accordingly, the application is ordered.

4.Post the matter on 06.12.2019 for written statement.
