..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent Nos.1 to 3, their men, agents, and servants, not to construct any type of structure, or drainage channel, and not to do anything under the guise of Panchayat drainage channel construction, on the petitioner's Patta land in Natham Survey No.57/2 and to direct the respondents not to interfere with the peaceful enjoyment of the Schedule Property by the petitioners without due process of law. ORDER

This writ petition is filed to direct the Respondent Nos.1 to 3, their men, agents, and servants, not to construct any type of structure, or drainage channel, and not to do anything under the guise of Panchayat drainage channel construction, on the petitioner's Patta land in Natham Survey No.57/2 and to direct the respondents not to interfere with the peaceful enjoyment of the Schedule Property by the petitioners without due process of law.

Learned counsel for the petitioners would submit that the respondents are forcibly attempting to construct a drainage channel through petitioners' property situated in S.No.57/2, Keezhkumaramangalam Village, Cuddalore District, without following the due process of law. Hence, the petitioners have come forward with the present writ petition, seeking direction to the respondents not to interfere with the peaceful enjoyment of the schedule property.

3. Learned Government Advocate appearing for the respondents would submit that the petitioner has not made any representation before the respondents. In the event, the petitioners makes any representation before the respondents by addressing their grievance, the same will be considered within a time frame to be fixed by this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the submission made by the learned counsel on either side, this Court without going into the merits of the case, issues the following direction:

(i) The petitioner is directed to make a representation before the respondents within a period of two weeks from the date of receipt of a copy of this order; (ii) On such receipt, the respondents are directed to dispose of the same on merits and in accordance with law, within a period of eight weeks thereof.

6. With the aforesaid directions, this writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 06-03-2026 Index: Yes/No Speaking/Non-speaking order VM
