The civil revision petition is filed to direct the Learned Principal District Judge, Tiruvallur to number the Suit in (Un-numbered) O.S. F. No.1555 of 2023 filed by the Petitioners herein and adjudicate the same without seeking Authority / Citation.
2. On a perusal of the records, it is noticed that, on 12.10.2023, the trial court has returned the plaint filed by the petitioners with the following reasons:
i) Plaintiffs to file any suitable authority for relief (d) of the plaintiff is maintainable? ii)Plaintiffs to file any suitable authority available for return No.1, dated 20.06.2023.
3. Further, while returning the plaint, the trial court has granted one month time to the petitioners to represent the plaint.
4. In view of the above, this civil revision petition is closed with liberty to the revision petitioners to represent the plaint, within a period of two weeks from the date of receipt of a copy of this order. After, representation, the trial court is directed to dispose of the case on merit. There shall be no order as to costs.
5. Registry is directed to return the original plaint to the petitioners immediately.
