OA. No.1079 of 2023 in C.S. No.133 of 2017 P.B.BALAJI, J., Today, Mr.S.Thangasivan, learned counsel for the respondents has filed an affidavit of undertaking of the respondent/defendant. The said affidavit has been executed before a Notary Public at Hong Kong on 04.07.2024. However, it is seen that a mistake has crept in at page 2, last paragraph, where it is stated ground floor flat, which is factually incorrect. However, in the same undertaking affidavit, in the last paragraph it clarifies the correct position, where it does not refer to location of the flat. The undertaking of the respondent/defendant is therefore recorded. The undertaking of the plaintiff has already been recorded on 16.07.2024.
