PRAYER : Transfer Civil Miscellaneous Petition filed under 24 of Code of Civil Procedure, pleased to withdraw the case in O.P.No.3308 of 2024 on the file of the learned IV Additional Family Court, Chennai and transfer the same to the file of the learned Family Court, Salem, and try along with O.P.No.459 of 2024.

ORDER

The petitioner wife has filed the above transfer C.M.P seeking to transfer H.M.O.P.No.3308 of 2024 pending on the file of the IV Additional Family Court, Chennai, to the file of the Family Court, Salem, to be tried along with O.P.No.459 of 2024.

2.She has given the following reasons for seeking a transfer:- a)She has filed an application for divorce against the respondent on the file of the Family Court, Salem, in H.M.O.P.No.459 of 2024 and thereafter the respondent has filed H.M.O.P.No.3308 of 2024 on the file of the IV Additional Family Court, Chennai.

b)She is taking care of her two sons all by herself and they are all residing at Salem.

c)The respondent has not been giving her any financial assistance despite which he wants to make her travel from Salem to Chennai to attend the proceedings. This is not only a physical strain on her but also a financial strain.

3.Heard the learned counsels on either side and perused the records.

4.Considering the above factors, the request made by petitioner wife appears reasonable and accordingly the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.3308 of 2024 is withdrawn from the file of the IV Additional Family Court, Chennai and transferred to the file of the Family Court, Salem, to be tried along with 2/4

O.P.No.459 of 2024. No costs. Consequently, connected miscellaneous petition is closed.
