This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the securities in the name of Mr.Sakthivel Vaiyapuri, husband of the 1st petitioner, father of the 2nd petitioner and son of the 3rd petitioner. Mr.Sakthivel Vaiyapuri, died intestate on 11.05.2021. The 2nd petitioner is the minor and is represented by the 1st petitioner. The 3rd petitioner had given his consent that Succession Certificate could be issued in favour of the 1st petitioner. The details of the securities had been given in the schedule to the petition.

2.After following due procedure, the petitioners were invited to tender evidence. Accordingly, the 1st petitioner examined herself as PW-1 and she marked Exs.P1 and P2, the Death Certificate and the Legal Heirship Certificate of her husband. The documents relating to the securities were marked as Ex.P3.

smv 3.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the 1st petitioner in accordance with the rules.
