Prayer: Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the records relating to the notice dated 30.10.2023 in Na.Ka.No.546/2018/A2 issued by the 3rd respondent, quash the same and consequently direct the respondents herein to confirm allotment of house at Door No.94 (WP.34289/23) and Door No.78 (WP.No.34294/23) in favour of the petitioners under Periyar Samathuvapuram Scheme at Adyalachery Village, Cheyyur Taluk,

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.N.Raja, learned counsel for the petitioners and Mr.T.K.Saravanan, learned Government Advocate for the respondents.

2. The petitioners have already filed civil suits bearing O.S.Nos.74 and 75 of 2021. The defendants therein are also the respondents in the present writ petitions and the fact of filing of civil suits is suppressed by the petitioners in the present writ petitions. The suits are for permanent injunction restraining the defendants from in any manner interfering with the peaceful possession and enjoyment of the petitioners/plaintiffs over the schedule mentioned

property by evicting them.

3. In the present writ petitions, the petitioners are challenging the eviction notice. The petitioners may seek appropriate remedy as may be permissible under law.
