Despite the interim order passed on 30.01.2019, the order has not been executed. Now, the applicant seeks further time on the ground that there is a mistake in the vehicle number, further time may be extended. It is to be noted that any interim order sought or obtained under Section 9 (ii) of the Arbitration and Conciliation Act, 1996 cannot be allowed to continue indefinitely. It is also to be noted that Section 9(ii) of the said Act makes it clear that there must be initiation of arbitration proceedings within 90 days from the date of receipt of a copy of the order. Without exhibiting any intention to initiate arbitration proceedings, one cannot take advantage of the interim order.

Hence, this application is dismissed.
