ORDER
The petitioner seeks a direction upon the 2nd respondent to issue legal heir certificate to him, by receiving his application seeking legal heir certificate.
2. Mr.R.Neelakandan, learned Additional Advocate General, assisted by Mrs.S.Anitha, learned Special Government Pleader, accepts notice on behalf of the respondents. In view of the consent expressed by the learned counsel for the parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner's father T.Purushothaman was the only son of his parents, namely V.Raman Kutty Nair and T.Rajalakshmi Ammal. His father pre-deceased his mother on 18.05.2006 leaving behind the petitioner, his brother and sister as his surviving legal heirs, and the Page No.2 of 6
petitioner's mother pre-deceased the petitioner's father. Thereafter, the petitioner's grandmother died 12.05.2008. After her demise, the petitioner has approached the 2nd respondent seeking for issuance of legal heir certificate. However, the request of the petitioner was not considered by the 2nd respondent. Hence, the petitioner has filed this writ petition before this Court for appropriate orders.

Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court, issues a direction to the 2nd respondent to receive the application seeking legal heir certificate for the petitioner's grandmother and issue legal heir certificate to the petitioner, within a time frame that may be stipulated by this Court.

The learned Additional Advocate General appearing for the respondents submitted that as per G.O.(Ms)No.110 dated 13.03.2024, the petitioner, who is the grandson of the deceased, is not the legal heir of the deceased, but his father is the legal heir of the deceased and thereby, he is not entitled to seek legal heir certificate for the death of the deceased by mentioning his name. However, if the petitioner sends a Page No.3 of 6
fresh representation seeking legal heir certificate, the same will be considered and the legal heir certificate will be issued by by the 2nd respondent, mentioning the name of the petitioner's father alone.

In view of the above, the petitioner is directed to send a representation to the 2nd respondent along with a copy of this order, within a period of one (1) week from the date of receipt of a copy of this order. Upon receipt of such representation, the 2nd respondent shall consider the same and pass appropriate orders, on merits and in accordance with law, within a period of four (4) weeks thereafter, after affording an opportunity of personal hearing to the petitioner and aggrieved persons, if any.
7. With the above direction, this Writ Petition is disposed of. No costs.
