PRAYER Petition filed under section 482 of Cr.P.C., to call for records pertaining to the CC.No.190 of 2025 pending on the file of the Learned Judicial Magistrate-II, Poonamallee and consequently set aside the quash the same and pass such other or further orders as this Court may deem fit and necessary in the circumstances of the case and thus render justice.

ORDER
This petition is filed by the petitioner seeking to call for records pertaining to the CC.No.190 of 2025 pending on the file of the Learned Judicial Magistrate-II, Poonamallee and consequently set aside the quash the same.
2. It is the contention of the petitioner that charge sheet has been filed by the 1 st respondent and he has been ceased of from investigation and now the investigation is transferred to the file of 2 nd respondent and the same is gross miscarriage of justice. The reason for transfer of investigation is on account of proven allegation of bias on the 1 st respondent. Hence, he prayed for quashing
of calender proceedings pertaining to CC.No.190 of 2025 pending on the file of Judicial Magistrate-II, Poonamallee.
3. Heard both sides and perused the materials available on record.
4. At the outset, the very contention of the petitioner has no course in the eye of law. On perusal of the statement given by the victim, serious allegations have been made against the petitioner attracting the ingredients of the offence under section 296(b), 115(2) and 351(2) of BNSS r/w.section 4 of Tamil Nadu Prohibition of Harassment Against Woman Act, constituting the offence of outraging the modesty of a woman.
5. This Court is of the view that whether the statements given by the victim are truly made or motivated, are the matter of evidence to be scrutinised before the trial court during trial proceedings. In such a view of the matter, I do not find merits in this petition. Hence, this petition is dismissed. Consequently, the connected miscellaneous petitions are closed.
6. After dismissal of this petition, learned counsel for the petitioner seeks
to dispense with the personal appearance of the petitioner before trial court in C.C.No.190 of 2025.
7. The personal appearance of the petitioner is dispensed with before the trial Court, except for receipt of copies, answering the charges, questioning under section 313 Cr.P.C. and on the date of pronouncing judgment and on any other dates as fixed by the trial Court.
