JUDGMENT
(Delivered by S.M.Subramaniam J.) The present writ appeal has been instituted challenging the writ order dated 17.03.2022 passed in W.P.No.16408 of 2020.
2. The writ petitioner is the appellant before this Court. The petitioner was appointed as Over Head Tank Operator on 25.02.1991 at Neelangari Panchayat. He was allowed to retire from service on attaining the age of superannuation on 31.01.2020. The writ petition has been instituted seeking regularization of service with retrospective effect. The writ Court considered the issues and made a finding that the appellant worked as Over Head Tank Operator in a non-sanctioned post from 25.02.1991 and retired from service on 31.01.2020. The impugned order would show that though the petitioner is not entitled for regularization, the Board has granted the benefit of regularization of service in favour of of the appellant with effect from 13.12.2018, which itself is a concession granted to the appellant by the Board.
The benefit of regularization was granted two years prior to the date of his retirement and pertinently, after receiving all the terminal benefits, the appellant filed the writ petition seeking retrospective regularization. That being the factum, the order of the writ Court is in conformity with the established principles of law of regularization and thus, no further interference is required.
