Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents to take action to dispose of the petitioner's representation dated on 7.08.2023 and 9.11.2023 submitted with regard to survey the petitioner's land by meets and bounds, land properties of an total extent of 4800 sq.ft (445.93 sqr. mtr.,) comprised in Survey no. 410 , vide Patta No. 1247 , situated at Thottipalayam Village, Tiruppur North Taluk, Tiruppur district by making proper sub-division as per the sale deed dated on 1.10.2015 in Document No. 11295/ 2015.

The writ petition is filed in the nature of Mandamus, seeking direction for the respondents, to consider the petitioner's representation dated 07.08.2023 and 09.11.2023.

The grievances of the petitioners are that they made a representation before the respondents on 7.08.2023 and 9.11.2023 to survey the petitioner's land by making proper Sub-division, as per the sale deed dated 01.10.2015, but the respondents have not taken any steps for the same so far. Therefore, the petitioners have filed the present writ petition.

Therefore the respondents are directed to issue notice to the petitioners as well as the adjacent owners and interested parties / rival claimants, if any, and thereafter, conduct the inquiry in the manner known to law and pass appropriate orders on merit in accordance with law. If the petitioner is otherwise found eligible, then the respondents are directed to consider the representation and pass appropriate orders within a period of three months from the date of receipt of a copy o this order.

4. With the above directions, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.

5. As only one petitioner has paid the court fee whereas this petition has four petitioners, all the petitioners are directed to pay the Court fee separately, otherwise the writ petition will stand dismissed against the writ petitioners on behalf of whom the court fee has not been paid. 22.11.2023 Index : Yes Speaking Order (sha) 3/4
