ORDER

This Criminal Original Petition is filed under Section 528 of BNSS, to direct the respondent police not to harass the petitioner and his two sons, namely Mr.D.Jaya Arul Raj and Mr.D.Vijay, in connection with CSR No.292/2025 on the file of the Kannankurichi Police Station.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent-Police and perused the materials available on record.

The learned Government Advocate [Criminal Side] On instructions submitted that based on the complaint made by the defacto complainant, CSR No.292 of 2025 has been registered and the current paper enquiry is pending against the petitioners and the petitioners were called for enquiry and the respondents have not harassed the petitioners. 2/4

4. In such view of the matter, it is for the investigating agency to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry and on such notice, the petitioners shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the respondent shall register the First Information Report and proceed as per law.
