Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to furnish the information sought by the petitioner as mentioned in RTI application dated 11.04.2022 and consequently, directing the first respondent to dispose of the second appeal in S.A.No.12321/F/2022 by imposing penalties on the 2nd to 4th respondent as per Section 20 of the Right to Information Act, 2005 within a stipulated period of time as fixed by this Court. ORDER
This Writ Petition has been filed in the nature of a Mandamus seeking a direction against the respondent to furnish information as sought in the Right to Information application dated 11.04.2022 and to direct the 1st respondent to dispose of S.A.No.12321/F/2022 and also impose penality to the 2nd to 4th respondent. The petitioner places reliance on Section 20 of the Right to Information Act, 2005.
2.In the affidavit filed in support of the writ petition, it had been stated that the petitioner had filed an application under the Right to Information Act before the 3rd respondent, the Public Information Officer, Block Development Office, Nallur Village Panchayat, Cuddalore. But however, the application was never considered and was kept pending. 3.The petitioner then filed an appeal on 30.05.2022 before the 2nd respondent, the Appellate Public Information Officer, Project Director, District Rural Development Agency (DRDA), Cuddalore. The 2nd respondent directed the 3rd respondent to furnish the information. But even after receipt of the said direction on 10.06.2022, the 3rd respondent had not provided the information. It was under those circumstances, that the petitioner had approached this Court by filing the present Writ Petition. 4.
Pending the Writ Petition, it is informed by both the learned counsel for the petitioner and the learned counsel counsel for the 3rd respondent that necessary information had been granted to the petitioner.
grievances that it was not properly authenticated. The authenticated details had also been granted to the petitioner, which is also acknowledged by the learned counsel. It is also informed that S.A.No.12321/F/2022 had also been disposed of by the 1st respondent.
5.In view of the above statements, no further issue arises for adjudication in this Writ Petition. Accordingly, this Writ Petition stands disposed of. No costs.
