Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 3rd respondent to enhance the compensation awarded to the petitioner's land acquired in Re-Survey No.21 measuring to an extent of 1200 square feet of lands 1/5

situate at Village No. 39, Karuvadikuppam Revenue village, Oulgaret Taluk, Puducherry District in Award No.1 of 2009 dated 21.01.2009 based on the petitioner's representation dated 23.05.2024 under Section 28-A of the Land acquisition Act within a stipulated time and to pass For Petitioner : Mr.C.Prabakaran For Respondents : Mr.M.Nirmal Kumar Government Advocate (P) Order Heard Mr.C.Prabakaran, learned counsel appearing for the petitioner and Mr.M.Nirmal Kumar, learned Government Advocate (P) who takes notice on behalf of the respondents. With consent, the main Writ Petition is taken up for final disposal at the stage of admission itself.

The petitioner has filed this Writ Petition seeking for the following prayer:- i) For issuance of a mandamus directing the 3rd respondent to enhance the compensation awarded to the petitioner's land situate at Village No. 39, Karuvadikuppam Revenue village, Oulgaret Taluk, Puducherry District in Award No.1 of 2009 dated 21.01.2009 based on the petitioner's representation dated 23.05.2024 .

3. Learned counsel for the petitioner would submit that the petitioner would be satisfied if the representation made by him seeking for aforesaid prayer is considered and disposed of in a time bound manner.

4. The learned Government Advocate (P) for the respondents fairly submitted that the representation made by the petitioner would be considered and disposed of in accordance with law within the time, as stipulated by this Court.

5. In view of the submission made by the learned Government Advocate (P) for respondents and considering the limited scope of the prayer, sought for by the petitioner, in this Writ Petition, this Court, without expressing any view with regard to the merits of the contentions putforth by the petitioner either in the Writ Petition or in the representation, is of the view that, suffice it would be to direct the third respondent to consider and dispose of the petitioner's representation in a time bound manner. 3/5

Accordingly, the Writ Petition is disposed of with a direction to the third respondent to consider the representation made by the petitioner's dated 21.01.2009 and dispose of the same as early as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order, No costs.
