The petitioners have filed this writ petition seeking issuance of Writ of Certiorari to call for the records made in Order passed in MWPSC No.37 of 2023, dated 03.09.2024 on the file of first respondent and quash the same as illegal, arbitrary, biased, highhanded and without Jurisdiction.
2.The learned counsel appearing for the petitioners submitted that the petitioners are the sons of the second respondent. The second respondent is an age old lady and could not climb the staircase, however, at the instigation of the respondents 3 and 4 made complaint before the first respondent and without considering the same, the first respondent directed the second petitioner to hand over the key to first floor of the property to the second respondent. The learned counsel fairly conceded that the property stands in the name of the second respondent and her deceased husband/ parents of the petitioners.

3.The learned counsel appearing for the second respondent submitted that the second respondent was residing in the first floor of the property and she was deliberately evicted from the first floor, thereby made complaint before the first respondent and the first respondent directed the second petitioner to hand over the key to first floor of the property to the second respondent. The learned counsel further submitted that the second respondent is not claiming any maintenance amount from the petitioners. The second respondent want to protect the property for her decent residence in her property and appreciating the same, the first respondent passed the impugned order, which warrants no interference.

pri 5.The writ petition is dismissed. If at all the petitioners have any grievance, the petitioners are at liberty to approach the competent civil Court for appropriate remedy. No costs. Consequently, the connected miscellaneous petition is closed.
