Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent consider the protest petition dated 11.07.2025 from the petitioner and in the light of order passed by the second respondent in his proceedings in Na.Ka.A5/617/2025 dated on 21.07.2025 directing the first respondent not register any document pertinent to survey number 456/2A2B 0.00.5 Ares at U.Keeranur Village, Udundurpet, Kallakurichi district. 1/6

ORDER

This writ petition is filed by the petitioner to direct the first respondent consider the protest petition dated 11.07.2025 from the petitioner and in the light of order passed by the second respondent in his proceedings in Na.Ka.A5/617/2025 dated on 21.07.2025 directing the first respondent not register any document pertinent to survey number 456/2A2B 0.00.5 Ares at U.Keeranur Village, Udundurpet, Kallakurichi district.

2. Mr.Abishek Murthy, learned Government Advocate takes notice on behalf of respondents 1 & 2. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

3. Learned counsel for the petitioner would submit that the petitioner is the owner of the property comprised in survey No.456/2A2B to an extent of 0.00.5 ares at U.Keeranur Village, UlundurpetTaluk, 2/6

Kallakurichi District and he has given a protest petition dated 11.07.2025 for registering any documents in regard to the aforesaid property, since some of the third parties are trying to alienate the same, without any ownership right. Hence the petitioner has come forward with the present writ petition.

After getting instruction, learned Government Advocate appearing for the respondents 1 & 2 submitted that in the present case, they have received a protest petition dated 11.07.2025 from the petitioner. So far, no document has been filed to register the aforesaid property in S.No.456/2A2B to an extent of 0.00.5 ares of land, hence they are not in a position to dispose the protest petition dated 11.07.2025. However, they assure that the said petition will be kept on record and in the event anyone submits the documents for registering the above said property, due notice will be issued to the petitioner, since he has lodged a protest petition dated 11.07.2025.

5. Heard the learned counsel on either side and perused the materials available on record.

In view of the above facts and circumstances of the case, this Court directs the official respondents to issue notice as well as opportunity of personal hearing to the petitioner, if anyone submits the documents for registering the aforesaid property and thereafter, pass appropriate orders on merits and in accordance with law. With the aforesaid direction, this writ petition is disposed of. No costs.
