This petition has been filed by the petitioner to set aside the order dated 21.08.2025 passed in Crl.M.P.No.681 of 2025 in Crl.M.P.No.649 of 2025 on the file of the learned Additional District Judge, Special Judge for EC & NDPS Act Cases, Salem, and modify the condition that 'one surety should be blood relative' made in Crl.M.P.No.649 of 2025 dated 31.07.2025.

The learned counsel appearing for the petitioner submitted that learned Additional District Judge, Special Judge for EC & NDPS Act Cases, Salem, in Crl.M.P.No.649 of 2025 dated 31.07.2025, has granted bail to the petitioner with a condition that "the petitioner shall execute the bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, in which one surety shall be blood relative and another shall be local surety each for a like sum to the satisfaction of the learned Magistrate concerned".

The contention of the petitioner is that the petitioner, being a native of a West Bengal and residing in Tamil Nadu for the past 15 years, has no blood relative to stand as surety, as her husband, who is her only relative, is also in custody in the same case. Hence, he seeks modification of the conditions.

Considering the facts and circumstances of the case, this Court modifies the above conditions to effect that "the petitioner shall execute the bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, in which one surety shall be native and another shall be local surety each for a like sum to the satisfaction of the learned Magistrate concerned".
5. Accordingly, this Criminal Original Petition is ordered. The other conditions shall remain unaltered.
