ORDER

Though the notice sent has been returned with the endorsement left, the learned counsel for the petitioner would submit that the respondent husband is very much aware about the pendency of this transfer petition, since he is appearing through video conferencing for 1/5

attending the proceedings in M.C.No.495 of 2024 and I.D.O.P.No.4239 of 2024. Therefore there appears to be deemed service since the respondent is also represented by counsel.

2.Taking note of the fact that two applications are now pending on the file of the III Additional Family Court, Chennai and the respondent husband is not in India and he is living abroad, it is immaterial whether the matter is pending before the Family Court, Perambalur or before the Family Court, Chennai. Therefore, I.D.O.P.No.26 of 2024 pending on the file of the XII Family Court, Perambalur, transferred to the file of III Additional Family Court, Chennai, to be tried along with I.D.O.P.No.4239 of 2024 and M.C.No.495 of 2024. 3.Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
