ORDER
This Criminal Miscellaneous Petition has been filed by the petitioners, seeking suspension of the sentence imposed by the learned Principal Sessions Judge, Tiruppur, in Crl.A.No.125 of 2024, dated 24.07.2025, confirming the Judgment dated 01.03.2024 passed in C.C No. 804 of 2019 by the learned Judicial Magistrate No.IV, Tiruppur and to enlarge the petitioners on bail pending disposal of the above Criminal Revision. 2.
The petitioners herein are the accused in C.C No. 804 of 2019 on the file of the learned Judicial Magistrate No.IV, Tiruppur. The appellants were found guilty of the offence under Sections 147, 341, 294(b), 323 and 506(ii) of IPC. The 1st accused was convicted and sentenced to undergo six months of rigorous imprisonment and to pay a fine of Rs.1,000/-, in default of which, he was directed to undergo one month of rigorous imprisonment under Section 324 of IPC. The 2nd appellant/A3 was sentenced to undergo one year rigorous imprisonment and to pay a fine of Rs.2,000/-, in default of which he was directed to undergo two months of rigorous imprisonment for the offence under Section 325 of IPC. Aggrieved by the same, the petitioners filed an appeal in Crl.A No.125 of 2024, and by order dated 24.07.2025, the learned 2/6
Principal Sessions Judge, Tiruppur, dismissed the appeal, thereby confirming the judgment and sentence imposed by the trial Court. Hence, the present revision has been filed.

The learned counsel for the appellants / petitioners submitted that there are arguable points available in the Criminal Revision Case and that the petitioners/A1 & A3 have a fair chance of succeeding in the same. Therefore, the substantive sentence imposed against the appellants may be suspended. He further submitted that the appellants/ petitioners are ready to abide by any condition imposed by this Court.

Heard the learned counsel appearing for the appellants / petitioners, the learned Government Advocate (Crl.Side) appearing for the respondent and also perused the materials placed on record. 5.
Considering the submissions made by both counsels, coupled with the quantum of punishment imposed upon the petitioners, and taking into account the fact that this Criminal Revision is not likely to be taken up for final hearing in the near future, this Court is of the view that the substantive sentence of imprisonment alone can be suspended on certain conditions. 3/6
6. Accordingly, till the disposal of the Criminal Revision Case, the reliefs of suspension of sentence and bail is granted on the following conditions:
(i) the appellants are directed to be enlarged on bail, on condition that each of them shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum, to the satisfaction of the Judicial Magistrate No.IV, Tiruppur, Tiruppur District. Further, the appellants shall appear before the said Court at 10.30 a.m. on the first working day of every English Calendar month, pending disposal of the Criminal Revision petition.
7. With the above directions, this Criminal Miscellaneous Petition is ordered.
