The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 118(1) and 351(2) of BNS, 2023, in Crime No.309 of 2024, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that due to previous enmity between the petitioner and the defacto complainant in respect of agricultural land dispute, on 31.10.2024, the petitioner abused the defacto complainant in filthy language and assaulted him with knife, due to which the defacto complainant sustained grievous injuries. Hence, the case. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that there is no previous case against the petitioner. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl. Side) would submit that due to wordy quarrel in respect of cultivation of agricultural land, the petitioner abused the defacto complainant in filthy language and assaulted him with knife and caused injuries to him. He would further submit that the injured is still in hospital. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5.Heard the learned counsel on either side and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case and the fact that the injured is still in hospital, this Court is not inclined to grant anticipatory bail to the petitioner at this stage. 7.Accordingly, this Criminal Original Petition is dismissed for the present.
