ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. It is stated that the cases against several other accused have already been split up and tried separtely in C.C.No. 358 of 2013 and the cases have ended in conviction, which is now pending in appeal. Some of the other accused have since died. As far as accused No.6, B.Nagabhushanam is Page No.1 of 3

concerned, the summons has not been served and the warrant has also been pending since 2002.

3. Considering the efflux of time, despite best efforts the accused is not traceable; even if he is brought to trial it would impinge upon his right to a speedy trial and no meaningful trial is now possible.

4. Accordingly, the cases in C.C.Nos. 881, 883 & 882 of 2025 on the file of the Judicial Magistrate No.V, Coimbatore Taluk, Coimbatore shall stand quashed and these Suo Motu Transfer Cases stand disposed of. 15.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
