The petitioner/A5, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 69 and 351(2) of Bharatiya Nyaya Sanhita (BNS), 2023 r/w Section 3(1)(w)(t) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities Act), 1989 in Crime No.7 of 2024, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution as per the de-facto complainant P.J.Yamini Jothi is that one Guru Guhan, who is studying second year MBA at Vel's College got acquaintance with the de-facto complainant. He had a physical relationship with the de-facto complainant on the false promise that he will marry her and cheated her as she belongs to minority community. During family meeting the parents of Guru Guhan have verbally abused the de-facto complainant and her family members with caste name. Hence, the case.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that the said Guru Guhan is petitioner's cousin sister's son, other than the relative of the main accused, the petitioner/A5 has nothing to do with the alleged offence and further, there is no specific allegation, as against this petitioner under the SC/ST (POA) Act. He would further submit that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
4.Mr.S.Kishore, learned counsel takes notice for the 2nd respondent/de-facto complainant.
5.The learned Government Advocate (Crl. Side) would submit that based on the complaint given by the de-facto complainant, a case was registered against the petitioner and other accused. He would further submit that investigation has been completed and the petitioner is not an accused as on date.
