Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus, to direct the respondent to forthwith register the sale deed of the petitioner dated 18.10.2024 without insisting for the original parent document dated 28.10.2005 (Document No.2641 of 2005) and the original General Power of Attorney Deed dated 02.11.2009 (Document No.913 of 2009) after obtaining an affidavit of undertaking from the petitioner.

The Writ Petition is filed seeking mandamus to the respondent to register the sale deed of the petitioner dated 18.10.2024 without insisting for the original parent document dated 28.10.2005 (Document No.2641 of 2005) and the original General Power of Attorney Deed dated 02.11.2009 (Document No.913 of 2009) after obtaining an affidavit of undertaking from the petitioner.

2. Heard the learned counsels on the either side and perused the records.

3. In the light of the Judgement passed by this Court in Ramayee - Vs - The Sub Registrar and others - (2020 (6) CTC 697), the 2/5

respondent is bound to register the sale deed. However, since the power agent has executed the sale deed, the power of attorney has to be submitted when the sale deed is presented for registration. On such representation, the respondent shall register the same, within a period of 2 weeks from then.
