ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.08.2025, for the offences punishable under Sections 296(b) and 109 of BNS (Corresponding Sections 294(b), 307 of IPC) in Crime No.142 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that on 12.08.2025 at about 10:45 p.m., the petitioner demanded money from one Lawrence, who is the brother of the defacto complainant; that while the same was refused, a wordy quarrel arose; that thereby the petitioner assaulted the defacto complainant's brother with stone and caused grievous injuries to him. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 14.08.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the injured is still in hospital; that the nature of injuries is grievous and the victim is suffering one side paralyse, on account of injury sustained; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the injured still in hospital, nature of injury sustained by the victim and the fact that investigation is pending, this Court is not inclined to grant bail to the petitioner.
