ORDER

The petitioners, who were arrested and remanded to judicial custody on 13.07.2025, for the offences punishable under Sections 8(c) r/w 20(b)(ii)(A), 22(C), 25 and 29(1) of NDPS Act, 1985 in Crime No.494 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that based on a secret information, the respondent police went to the spot and found that the A1/Vasanth was in illegal possession of 5.25 grams of Methamphetamine for the purpose of sales; that thereafter, based on the confession of A1, A2/Karthik and A3/ Akash were arrested, who were in illegal possession of LSD stamp 0.81 grams and 350 grams of ganja respectively. Upon investigation and confession of them, it is revealed that A2 purchased the contraband and stocked in A1's house, where the petitioners herein and other accused persons convert the contraband into small packets and sell the same to various persons. Hence, this case. 3.

Mr. R. Srinivas, learned Senior counsel appearing for the 2/6

petitioner/ Arun Parikshith submitted that the petitioner was falsely implicated in this case and he is an architect by profession and except his presence in the house of co-accused, no other allegation was levelled against the petitioner. He further submitted that there is no seizure from this petitioner and the FIR was registered belatedly on the next day of occurrence. He also submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned counsels for other petitioners/ A3, A6 and A8 also submitted that there is no recovery from these petitioners and they were not present at the scene of occurrence and sought for bail to the petitioners. 5.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that initially the recovery was made from A1, A2 and A3 and upon investigation and their confession, it is found that the petitioners and other accused were present at the house of A1 and involved in the offence of packing the contraband into small packets for the purpose 3/6

of selling the same to various other persons. He also submitted that weighing and packing machine used for packaging of the contraband was also recovered from the house of A1. He also submitted that the chemical analysis report is yet to be received and the investigation is pending. 5.

Considering the facts, gravity of offence, the fact that one of the contraband seized from the accused is of commercial quantity, the fact that weighing and packing machines were recovered from the house of the accused, which is used for packaging of contraband, the conditions under Section 37 of NDPS has not been satisfied and the investigation is also pending, this Court is not inclined to grant bail to the petitioners. 6.

Accordingly, these criminal original petitions stand dismissed. 22.09.2025 stn 4/6
