O R D E R

This Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation in Crime No.383 of 2024, currently pending on the file of the 2nd respondent, to the CB-CID or any other 1/6

competent and independent investigation agency, for ensuring a fair, impartial and expeditious investigation.

2. The case of the petitioner is that he lodged a complaint on 29.09.2025 with the 2nd respondent herein regarding the continued harassment and unlawful interference of his neighbour, Ranganathan with his property. It is his contention that the said Ranganathan, with malafide intention, filed a false petition before the Melmalaiyanur Taluk Office as if the petitioner's patta land is a Government Poramboke land. Upon this false petition, on 27.09.2025, a protest was staged in front of the Taluk Office, orchestrated with the support and influence of some political party, to cause reputational damage and distress to the petitioner and thereby disturbing the peaceful enjoyment of his property.

Subsequently, the Taluk Office authorities, conducted a land survey through a designated Government Surveyor and it clearly confirmed that the disputed land was indeed patta land belonging to the petitioner. Despite the same, the protest was carried out. When the matter stood so, the petitioner's son expressed his extreme distress and fear to the petitioner stating that 'they would not leave me without beating me to death'. Following this, he left for the Melmalaiyanur Taluka Office, where he attempted to seek protection or redress by approaching the Tahsildar.

Tahsildhar reportedly behaved negligently and used obscene and derogatory language to the petitioner's son. Deeply humiliated and emotionally shattered by the harassment, threats, and public defamation, the petitioner's son committed suicide by self immolation. In this regard he has also left a suicide note implicating 23 persons whereas, the FIR has been registered only against 19 persons. Therefore, the present petition is filed.

3. The learned Government Advocate (Crl. Side) submitted that the FIR has been registered against all the persons named in the complaint. Now only, the so called copy of the suicide note was handed over wherein 23 persons have been named including officials and that the original suicide not has not been produced. If the original is produced, the same will be sent to Forensic Lab and based on the lab report, the investigation will be conducted and if it is found that all the named persons are involved, they would proceed further in accordance with law.

4. Considering the facts and circumstances, let the investigation be monitored by the Deputy Superintendent of Police, Villupuram. It is made clear that the investigation has to be conducted in a fair manner. Merely because of some steps taken by the Government Officials, the affected person committed suicide, it cannot be held that they abetted the offence.

5. Whether abetment was really caused by the authorities or not, has 3/6

to be probed throughly in the investigation and to file a report.

6. With the above directions, this Criminal Original Petition is disposed of.
