CMP.No.25843 of 2024 in C.M.A.No.SR.148029 of 2024 M.DHANDAPANI,J.

This petition has been filed to condone the delay of 237 days in filing the CMA.

2. The learned counsel for the appellant submitted that the first respondent has already set as ex-parte before the trial court.

3. Hence, notice to the first respondent is dispensed with. Private notice sent to the second respondent has been served on 26.11.2024 and name of the second respondent has been printed in the cause list, but there is no appearance on behalf of the second respondent today.

4. The affidavit filed in support of this petition has been perused and on being satisfied with reasons stated therein, this Court is inclined to condone the delay.

5. Accordingly this petition is allowed.
