O R D E R

When the matter was taken up for hearing, affidavit of the respondent was filed and the relevant portion is extracted hereunder:

"

4. I submit that the Canara Bank, Teynampet has sent a requisition letter to the 2nd respondent/J-9, Thuraipakkam Police Station, Chennai seeking police protection of land measuring 3813 sq.feet situated at No.17, Pillayar Kovil Street, Perungudi, Chennai under Section 14 of the SARFAESI Act which was mortgaged loan for a sum of Rs.2 Crores by M/s.Devika Enterprises, Mr.G.Ravindra Kumar, who is owner of the property.

I submit that based on that, on 03.05.2024 the 2nd respondent police about 40 of them went to the said property with the help of the police persons, the Advocate Commissioner and Bank staff to give police protection to Bank and their agents for evacuated the occupants inside the building and sealed the premises. But, the occupants refused to take their belongings, hence inventory and prepared. During this process under the SARFAESI Act, the bank staff has locked and sealed the household items of the defaulter inside the building as per Hon'ble Court order dated 26.03.2024.

6. I submit that during the course of enquiry, the said Canara Bank had advertised in a newspaper to collect the household articles sealed in the building on or before 20.05.2024.

7. I submit that during the course of enquiry, on 08.11.2024, the Asset Recovery Management Branch has submitted a petition before the 2nd respondent to move the inventories to their warehouse and the same was forwarded to the

Commissioner of Police, Greater Chennai Police for police strength.

8. I submit that based on that, on 12.11.2024, the 2nd respondent police has given complete police protection to Bank and their agents for vacating the premises and all the shop and house vacated.

Thereafter, the Canara Bank, Asset Recovery Management Branch, Teynampet, Chennai given acknowledgement / receipt to the 2nd respondent."

2. Learned counsel for the petitioner also confirms the fact that police protection was given and a decision has been taken.
