ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.08.2025 for the alleged offences under Sections 296(b), 118(1) of BNS @ 296(b), 105 of BNS, in Crime No.252 of 2025, on the file of respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that there was a family dispute regarding the division of property. On that day, a wordy quarrel took place, after which the deceased recovered. She did not sustain any grievous injuries, and she later died due to some other ailment. However, the petitioner has been falsely implicated as if he had committed the murder of the deceased. Hence, he prayed for bail.

3. The learned Government Advocate (Crl. Side) submitted that there are a total of three accused in this case, in which the petitioner has been arrayed as A1. He further submitted that a wordy quarrel occurred on that day, and due to the family dispute, the deceased was brutally attacked by the three accused. Out

of them, only A1 has been secured, while A2 and A3 are still absconding. Therefore, the case is still under investigation. Hence, he vehemently opposed to grant bail to the petitioner.

4. Considering the facts and circumstances, that the investigation is not yet completed, at this stage, if he is released on bail, he may abscond, tamper with the evidence, and hamper the witnesses. Therefore, this Court is not inclined to grant bail to the petitioner.
