O R D E R

The petitioners, who were arrested and remanded to judicial custody on 01.08.2025, for the offences punishable under Sections 126(2), 296(b), 311, 351 (3) of BNS Act in Crime.No. 234 of 2025 on the file of respondent police, seeks bail.

2. The case of the prosecution is that the petitioners attacked the defacto complainant and also robbed a sum of Rs.500/- at knife point. Hence, the case.

3. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He also submitted that the petitioners are no way connected with the alleged offence however, they are suffering incarceration from 01.08.2025. He further submitted that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that this is a second bail application and this Court, by order dated 20.08.2025, dismissed the first bail petition in Crl.O.P.No.23083 of 2025. He submits that this a case of double murder and the petitioners are arrayed as A1 and A2. He also submits that A1 is having 15 previous cases pending against him and A2 is having one previous case pending against him. He also submits that there is no change of circumstances in this case. Hence, he strongly opposed to grant bail to the petitioners.

Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), considering the fact that this is a 2nd bail application and there is no change of circumstances in this case, this Court is not inclined to grant bail to the petitioners.
