ORDER

The petitioner, who was arrested and remanded to judicial custody on 28.01.2025 for the alleged offences under Sections 420 of IPC and Sections 10 & 24 of the Emmigration Act, in Crime No.16 of 2025, dated 28.01.2025, on the file of respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that he has been arrayed as A2. The petitioner is working in Portugal, and he has been falsely implicated in this case as if he had conspired with A1 and collected a sum of Rs.2,26,00,000/- by giving false promises to nearly 193 victims. He further submitted that the petitioner has been suffering incarceration from 28.01.2025. Hence, he seeks the grant of bail to the petitioner.

3. The learned Government Advocate (Crl. Side) submitted that while being in Portugal, the petitioner was operating the entire scam, in which about

193 victims were cheated and a sum of Rs.2.23 crores was collected from them. He further submitted that so far no amount has been recovered, and the petitioner is the main mastermind behind the offence. The investigation is still at an initial stage. Hence, he vehemently opposed the grant of bail to the petitioner.

4. On considering the submissions of both sides, this Court finds that the investigation is still in progress and no amount has been recovered. Furthermore, if released on bail, the petitioner may abscond. Therefore, this Court is not inclined to grant bail to the petitioner.
