ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.01.2024 based on execution of NBW dated 03.03.2017 in S.C.No.04 of 2017 on the file of the Learned I Additional District & Sessions Judge, Coimbatore, registered for the offences punishable under Sections 302, 324 and 306 of IPC in Crime No.55 of 2016 on the file of the respondent police, seeks bail.

The learned counsel appearing for the petitioner submitted that originally the petitioner was arrested and released on bail and was regularly appearing before the Trial Court for the case in S.C.No.04 of 2017 and due to his non-appearance before the Trial Court, when the case is posted for framing of charges on 03.03.2017, a NBW was issued as against the petitioner and subsequently, the petitioner was arrested on 19.01.2024. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 3.

The learned Government Advocate (Criminal Side) appearing 2/4

for the respondent while opposing the bail to the petitioner submitted that since the petitioner failed to appear before the Trial Court, a NBW was issued and subsequently, he was arrested. He further submitted that most of the witnesses in this case were examined and the trial is at the stage of arguments and further the petitioner is charged for the offence under Section 302 of IPC and he has absconded for more than 6 years. 4.

Considering the facts of the case, the charges against the petitioner, the petitioner has absconded for more than six years and taking note of the fact that most of the witnesses in this case were examined and the trial process is pending at the stage of arguments, this Court is not inclined to grant bail to the petitioner at this stage. 5.

Accordingly, this criminal original petition stands dismissed. 23.09.2025 stn 3/4
