This application has been filed by the applicant to grant leave to institute the suit as against the second defendant and the "B" Schedule Property.

According to the applicant, some of the properties are situated within the Jurisdiction of the Court and some of the properties are situated outside the Jurisdiction of the Court and the second defendant is also residing outside the Jurisdiction of the Court and the applicant filed the main Suit for the relief of partition. Therefore, he filed this application.

3. This Court perused the records and the substantial part of the cause of action arose within the Jurisdiction of the Court and the "A" and "C" Schedule Properties are within the Jurisdiction of the Court and the "B" Schedule Property is outside the Jurisdiction of the Court and the second defendant also resides outside the Jurisdiction of the Court. Therefore, considering the nature of the Suit and for the above-said reasons, this application is allowed. Leave is granted.

4. The Registry is directed to number the Suit if it is otherwise in order.
