Prayer: Criminal Original Petition filed under Section 428 of Cr.P.C./528 of B.N.S.S. praying to direct the respondents 1 to 3 to execute the bailable warrant issued against the 4 th respondent/accused in S.T.C.No.4796 of 2024 dated 14.05.2024 pending on the file of the Fast Track Court-I, Metropolitan Magistrate Court, Allikulam Campus (Egmore) Chennai. ORDER

This Criminal Original Petition has been filed by the petitioner to direct the respondents 1 to 3 to execute the bailable warrant issued against the 4 th respondent/accused in S.T.C.No.4796 of 2024 dated 14.05.2024, pending on the file of the Fast Track Court-I, Metropolitan Magistrate Court, Allikulam Campus (Egmore) Chennai.

2. When the matter came up before this Court on 08.11.2024, the learned Additional Public Prosecutor sought time for filing report. Today, they have filed the report stating that the respondent police went in search of the 2/5

accused/4 th respondent in the last known address given to them wherein, the Police were informed that the accused had already vacated the house and went to Bangalore.

3. The learned Additional Public Prosecutor submitted that despite the search conducted by the Special Team, they could not find the accused and a report is also filed before the Magistrate.

4. In such view of the fact, the petitioner is at liberty to work out his remedy before the Magistrate for fresh warrant.

5. With the above directions, this Criminal Original Petition is disposed of.
