NIRMAL KUMAR , J This petition is filed to condone the delay of 97 days in filing the above revision. 2.The petitioner is the de-facto complainant on whose complaint a case has been registered by the respondent police and filed referred charge sheet. The petitioner, who is aged about 85 years filed a protest petition giving all details and also bringing the fact that the accused has committed offence and there are sufficient materials. Despite the same, the Lower Court dismissed the protest petition, against which the present revision.

3.Mr.A.Damodaran, learned Additional Public Prosecutor takes notice for the respondent and he has got objection in condoning the delay.

4.In view of the above facts, this Court is inclined to condone the delay.

Accordingly, the delay stands condoned and the petitioner is ordered.
